GENERAL CONDITIONS OF SALE

Title I - INDIVIDUAL CUSTOMERS (B2C)

 

ARTICLE 1 - SCOPE OF APPLICATION 

These General Conditions of Sale (known as “CGV”) apply, without restriction or reservation, to all sales concluded by the Seller to non-professional buyers (“The

Customers or the Customer"), wishing to acquire the products offered for sale ("The Products") by the Seller on the site www.leparfait.com The Products offered for sale on the site are as follows: 

Plastic decorations for corks and closure capsules. 

Non-electric household or kitchen utensils and containers (neither of precious metal nor plated), pot lids, funnels, non-electric autoclaves and pressure cookers, cookware; raw or semi-worked glass (except that for construction); glassware, jars, porcelain, terracotta and earthenware. Metal locks and hardware. 

Metal closure caps Cooking and refrigeration appliances; sterilizers, autoclave pots, pressure cookers. Vacuum sealing machines and associated accessories. Printing products; books, magazines, guides. 

Rubber seals for jars. 

Textile or leisure accessories; 

The main characteristics of the Products and in particular the specifications, illustrations and indications of dimensions or capacity of the Products, are presented on the site www.leparfait.com which the customer is required to read before ordering, the photos are not contractual and the products may have slight variations. 

The choice and purchase of a Product are the sole responsibility of the Customer. 

Product offers are within the limits of available stocks, as specified when placing the order. 

These General Terms and Conditions are accessible at any time on the site www.leparfait.com and will prevail over any other document. The Customer declares to have read these General Terms and Conditions and to have accepted them by checking the box provided for this purpose before implementing the site's online ordering procedure. www.leparfait.com. 

Unless proven otherwise, the data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer. The Seller's contact details are as follows:

ARTICLE 2 – PRICE AND PROMOTION 

The Products are supplied at the current prices appearing on the site www.leparfait.com, when the order is registered by the Seller. 

Prices are expressed in Euros, excluding tax and including tax. 

The prices take into account any reductions which may be granted by the Seller on the site www.leparfait.com  

These prices are firm and cannot be revised during their period of validity but the Seller reserves the right, outside the period of validity, to modify the prices at any time. 

The prices do not include processing, shipping, transport and delivery costs, which are invoiced additionally, under the conditions indicated on the site and calculated before placing the order. 

The payment requested from the Customer corresponds to the total amount of the purchase, including these costs. 

An invoice is established by the Seller and given to the Customer upon delivery of the Products ordered and is sent by email or available from their customer account. 

DELIVERY offered to relay points in France from €59 of purchase is valid for any order less than or equal to 20 KG. For any order exceeding 20 KG the customer will not be able to benefit from this free charge and will have to pay delivery costs. 

 

ARTICLE 3 – ORDERS 

It is up to the Customer to select on the site www.leparfait.com the Products he wishes to order, according to the following terms: 

The Customer chooses a product that he places in his basket, a product that he can delete or modify before validating his order and accepting these general conditions of sale. He will then enter his contact details or log in to his account and choose his delivery method. After validation of the information, the order will be considered firm and final and will require to be honored. 

Product offers are valid as long as they are visible on the site, while stocks last. The photographs and graphics presented on the site are not contractual and don't would know engage the responsibility of Seller. 

The sale will only be considered valid after full payment of the price. It is the Customer's responsibility to verify the accuracy of the order and to immediately report any errors. 

Any order placed on the site www.leparfait.com constitutes the formation of a contract concluded remotely between the Customer and the Seller. 

The Seller reserves the right to cancel or refuse any order from a Customer with whom there is a dispute relating to the payment of a previous order. The Customer will be able to follow the progress of his order on the site. Any cancellation of the order by the Customer after its acceptance by the Seller will only be possible within 1 day at most after acceptance of the order by the Seller and as long as delivery has not taken place (irrespective of the provisions relating to the application or not of the legal right of withdrawal). 

The weight of an order cannot exceed 25 KG of merchandise by constraint of acceptance of our carriers. Your order will then be refused by our services and you will be contacted to re-place an order that we are able to deliver to you.  

In the event of a delay in receiving the package from the Customer resulting in the package being returned to the sender, the customer will have to pay the delivery costs again if they wish the package to be returned by the Seller. 

 

ARTICLE 4 - PAYMENT TERMS 

The price is paid by secure payment method, using the following method: payment by credit card 

In certain circumstances and after acceptance by our services, payment via bank transfer may be offered, the order will only be validated after receipt of payment.

The price is payable in cash by the Customer, in full on the day the order is placed. 

Payment data is exchanged in encrypted mode using the protocol defined by the approved payment provider involved in banking transactions carried out on the site. www.leparfait.com. 

Payments made by the Customer will only be considered final after effective collection by the Seller of the sums due. 

The Seller will not be required to deliver the Products ordered by the Customer if the Customer does not pay the price in full under the conditions indicated above. 

ARTICLE 5 - DELIVERIES 

The Products ordered by the Customer will be delivered in mainland France or in the following areas 

-  MONACO 

-  BELGIUM 

-  ITALY 

-  GERMANY  

-  SPAIN 

-  NETHERLANDS  

-  LUXEMBOURG 

-  SWITZERLAND after contacting customer service and subject to validation. Customs clearance remains the responsibility of the customer.

-  CROATIA

Other EU countries may be added.

Deliveries take place within 15 working days to the address indicated by the Customer when ordering on the site, for orders delivered in mainland France, for abroad the deadlines can be extended to 30 working days.

Delivery consists of the transfer to the Customer of physical possession or control of the Product. Except in special cases or unavailability of one or more Products, the Products ordered will be delivered in one go. 

The Seller undertakes to make its best efforts to deliver the products ordered by the Customer within the deadlines specified above. 

If the Products ordered have not been delivered within 5 days after the indicative delivery date, for any reason other than force majeure or the act of the Customer, the sale may be terminated at the written request of the Customer under the conditions provided for in articles L 216-2, L 216-3 and L241-4 of the Consumer Code. The sums paid by the Customer will then be returned to him at the latest within fourteen days following the date of termination of the contract, excluding any compensation or withholding. 

Deliveries are ensured by an independent carrier, to the address mentioned by the Customer when ordering and to which the carrier can easily access. 

When the Customer himself is responsible for using a carrier he chooses himself, delivery is deemed to have been made upon delivery of the Products ordered by the Seller to the carrier who accepted them without reservation. The Customer therefore acknowledges that it is up to the carrier to make the delivery and has no warranty recourse against the Seller in the event of failure to deliver the goods transported. 

In the event of a specific request from the Customer concerning the packaging or transport conditions of the products ordered, duly accepted in writing by the Seller, the related costs will be subject to additional specific invoicing, based on a quote previously accepted in writing by the Customer. 

The Customer is invited to check the apparent conformity of the Product delivered to the order as well as its external condition and to report any complaint relating to an apparent defect in the Product, easily detectable upon receipt or unpacking, within fourteen (14) days of receipt with any useful supporting evidence, in particular photographs, order reference and description of the apparent defect. 

Rapid reporting of delivery anomalies and apparent defects by the Customer facilitates the replacement of Products and the availability of ordered references within stock

ARTICLE 6 - TRANSFER OF PROPERTY 

The transfer of ownership of the Products from the Seller to the Customer will only be carried out after full payment of the price by the latter, regardless of the date of delivery of said Products. 

The transfer of the risks of loss and deterioration relating thereto will only be carried out at the time when the Customer takes physical possession of the Products. The Products therefore travel at the Seller's risk except when the Customer has chosen the carrier himself. As such, the risks are transferred when the goods are handed over to the carrier. 

ARTICLE 7 - RIGHT OF WITHDRAWAL  

In accordance with the provisions of article L. 221-18 of the Consumer Code, the Customer has a period of fourteen (14) days to exercise your right of withdrawal without having to give reasons for your decision. The period runs from the day of receipt of the Product, or of the last Product in the event of an order for several Products, by the Customer or a third party designated by him. 

7.1 Modalities of exercise

The right of withdrawal can be exercised online, using the withdrawal form attached to these General Terms and Conditions (and available on the site), or by any other unambiguous declaration expressing the desire to withdraw, addressed to the Seller at the contact details indicated in ARTICLE 1 [commande@leparfait.com].

In order for the withdrawal period to be respected, the Customer must send his communication relating to the exercise of the right of withdrawal before the expiration of the withdrawal period.

7.2 Return of products

The Customer must return the products no later than within fourteen (14) days following the communication of his decision to retract. The products must be returned in their original condition and complete (packaging, accessories, instructions, etc.) allowing them to be remarketed.

Return costs remain the sole responsibility of the Customer.

7.3 Reimbursement and depreciation of goods

The Seller will reimburse all amounts paid by the Customer, including delivery costs (at the standard rate), within a period of fourteen (14) days from the date on which he is informed of the Customer's decision to withdraw. The Seller may, however, defer reimbursement until actual recovery of the products or until the Customer has provided proof of shipment of these products, the date chosen being that of the first of these events.

The refund will be made using the same means of payment as that used by the Customer for the initial transaction.

Depreciation and discount: In accordance to the article L. 221-23 of the Consumer Code, the Customer is informed that his liability may be incurred towards the Seller in the event of depreciation of the product resulting from manipulations other than those necessary to establish the nature, characteristics and proper functioning of the property.

In the event of damage to the Product, the Seller may apply a discount to the reimbursement amount. Where applicable, the discount is proportionate to the costs of repairing the Product or its depreciation preventing it from being put back on sale in new condition, which corresponds to the loss of market value.

Examples of depreciation: For electrical products, any prolonged use, traces of wear, missing accessories or damaged original packaging making the product unsuitable for resale "as new" even reconditioned.

ARTICLE 8 - LEGAL GUARANTEES


 

“The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of the appearance of a lack of conformity. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date of its appearance. 

The legal guarantee of conformity gives the consumer the right to repair or replacement of the goods within thirty days of their request, free of charge and without major inconvenience for them. 

If the item is repaired within the framework of the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee. 

If the consumer requests repair of the good, but the seller requires replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the good. 

The consumer can obtain a reduction in the purchase price by keeping the goods or end the contract by being reimbursed in full against return of the goods, if:

1.      The professional refuses to repair or replace the item; 

2.      The repair or replacement of the goods takes place after a period of thirty days;

The repair or replacement of the good causes a major inconvenience for the consumer, in particular when the consumer definitively bears the costs of taking back or removing the non-compliant good, or if he bears the costs of installing the repaired or replacement good;

4. The non-compliance of the property persists despite the seller's unsuccessful attempt to bring it into compliance.

The consumer also has the right to a reduction in the price of the good or to the termination of the contract when the lack of conformity is so serious that it justifies the reduction in the price or the termination of the contract being immediate. The consumer is then not required to request repair or replacement of the goods beforehand. 

The consumer does not have the right to cancel the sale if the lack of conformity is minor. 

Any period of immobilization of the good for its repair or replacement suspends the guarantee which remained to run until the delivery of the restored good. 

The rights mentioned above result from the application of articles L. 217-1 to L. 217-32 of the Consumer Code. 

The seller who obstructs the implementation of the legal guarantee of conformity in bad faith incurs a civil fine of a maximum amount of 300,000 euros, which can be increased to 10% of the average annual turnover (article L. 241-5 of the Consumer Code). 

The consumer also benefits from the legal guarantee against hidden defects in application of articles 1641 to 1649 of the civil code, for a period of two years from the discovery of the defect. This guarantee gives the right to a price reduction if the item is kept or to a full refund against return of the item.

The content of the site www.leparfait.com is the property of Seller and of his partners and is protected by the laws French and international relating to the property intellectual 

Any reproduction total or partial of this content is strictly prohibited and is likely to constitute a crime of counterfeit 

ARTICLE 11 - APPLICABLE LAW - LANGUAGE  

The present General Terms and Conditions and the operations who in arise are management and submitted under French law. 

The present General Terms and Conditions are written in French language. In the case where they would be translated in a or several languages foreign, only the text French would do faith in case of dispute 

ARTICLE 12 - DISPUTES  

For all complaint thank you for contact customer service at the address postal or email from Seller indicated to the ITEM 1 of present T&Cs. 

The Customer is informed that he can in any circumstances resort to a mediation conventional, near instances of mediation sectoral existing or in any mode alternative of regulation of disputes (conciliation, by example) in case of protest.

All disputes to which the operations buying and selling concluded in application of present General Terms and Conditions and who would not have not done the object of a regulation amicable between the seller or by mediation, will be submitted to courts competent under legal conditions common 

In case of dispute between the professional and the consumer, those-this will strive of find a amicable solution.

 ARTICLE 13 – LOYALTY PROGRAM – LE PARFAIT  


The Loyalty Program Le Parfait (hereinafter “the Program”) is offered by Berlin Packaging | Le Parfait. Membership and use of the Program imply full acceptance of these conditions.

13.1. MEMBERSHIP OF THE PROGRAM


Registration is automatic upon creation of a customer account on the site or mobile application. Le Parfait. No registration fee is required.

13.2. CUMULATION OF POINTS

 
Loyalty points are awarded as follows:
- 1 € spent = 1 point
- Other actions generating points (non-exhaustive list):
- Subscribe to the Instagram account
- Complete your customer profile
- Subscribe to the newsletter
- Download or use the app
- Rate the application or leave a review (e.g. Trustpilot, Verified Review)
- Any other promotional action defined by the Company
The scale is subject to change without notice. Points are valid for 12 months. Any suspicion of fraud may result in point cancellation and account suspension.

13.3. USE OF POINTS


Points can only be exchanged via the site or mobile application, against:
- Discount vouchers or promo codes
- Exclusive products (while stocks last)
Points are neither transferable nor convertible into cash. Discount vouchers may be subject to a minimum purchase amount and are not necessarily cumulative.

13.4. LIMITATIONS AND RESTRICTIONS


The Program only applies to online purchases on the site or mobile application of Le Parfait. It does not cover physical stores or partner sites. Points are personal and non-transferable.

13.5. SPONSORSHIP


Sponsorship allows you to earn points after validation of the godson's order. Any attempt at fraud (self-sponsorship, false accounts) results in the deletion of winnings and suspension of the account. Conditions may be modified by Le Parfait.

13.6. MODIFICATION OF THE PROGRAM

 
Le Parfait reserves the right to modify, suspend or terminate the Program at any time without notice. Changes take effect as soon as they are published on the site or application.

13.7. PERSONAL DATA

Data collected under the Program is processed in accordance with the Company's Privacy Policy, which complies with the GDPR.

13.8. RESPONSIBILITY


The Company cannot be held responsible in the event of malfunction, fraud or temporary interruption of the Program.
